UCC SRC elections postponed due to interloculatory injunction case in court

The election of leaders for the Students Representative Council (SRC) and Local NUGS of the University of Cape Coast (UCC) for the 2015/2016 Academic Year has been postponed till further notice due to an Interlocutory Injunction case pending at the Cape Coast High Court.

The Court presided over by Justice Dapaah adjourned hearing of the interlocutory injunction to April, 1, 2015 and cautioned that all activities that would impede evidences and the smooth adjudication of the matter must be put on hold until the court determines the case.

By this, the SRC and Local NUGS elections that were scheduled to take place on Tuesday, March 31, 2015 have been suspended till further notice.

The writ was filed by Philip Glover and Jerald K. Tamba, all students of the University of Cape Coast, and the defendants of the suit include the University of Cape Coast, the Dean of Students of the University, and Francis Kwabena Arthur (Ag. SRC President) as first, second and third defendants respectively.

The writ among other things is praying for an Order of Interlocutory Injunction restraining the Acting SRC President from holding himself as the Acting SRC President of the University of Cape Coast pending the determination of the suit.

The writ argued that the Constitution was explicit that Acting President had a mandatory 21 days after which their mandate expired and therefore the current SRC Secretary should be sworn in as Acting President.

But Lawyers for the 1st, 2nd and 3rd defendants argued that the SRC had a different working constitution far from the one quoted by Counsel for the plaintiffs. The court is yet to determine this matter.

It can also be recalled that a case of contempt was earlier filed against the Ag. SRC President on grounds of being a signatory to the SRC Account, organizing General Assembly meeting and launching SRC Week Celebration even after he had been served with an interlocutory injunction.

Lawyer for the plaintiff, Kwame Owiredu argued that the Ag. SRC President was not supposed to function or carry himself as the Ag. SRC President since his legitimacy was in contention yet to be decided by the court and the Ag. SRC President disrespected the Court by continuing to carry himself as the UCC SRC President.

Meanwhile, the University, having failed to file an appearance in respect of the interlocutory injunction filed an appearance in court on Friday, March, 27, 2015

This action attracted the fury of the judge and he subsequently slapped a fine of GH¢600 on the University for filing a late appearance.
